JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 22-06-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. At the very outset, learned counsel for the petitioner seeks permission to make necessary correction in the bail petition. Permission is granted.
Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has preferred this application for grant of regular bail in a case registered under section 379 of the Indian Penal Code and later Sections 395 and 412 of the Indian Penal Code is added.
Allegation against the petitioner is that the petitioner
Patna High Court CR. MISC. No.8205 of 2022(2) dt.22-06-2022 2/3 is said to have snatched the motorcycle and mobile of the informant.
Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The name of the petitioner has surfaced on the confessional statement of co-accused, Ranjeet Chauhan. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is also accused in one more case i.e. Pakri Barawan P.S. Case No. 276 of 2020. Learned counsel for the petitioner further submits that the petitioner is in custody since 01.08.2021. Lastly, it is submitted hat co-accused persons have already been granted bail by coordinate Bench of this Court vide order dated 08.06.2022 passed in Cr. Misc. No.69599 of 2021. Learned A.P.P.
for the State has opposed the bail petition of the petitioner and submits that the name of the petitioner has sprung up on the confessional statement of coaccused, Ranjeet Chauhan. Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.
Patna High Court CR. MISC. No.8205 of 2022(2) dt.22-06-2022 3/3 with Pakri Barawan P.S. Case No. 213 of 2021. The application stands allowed.
