Heard learned counsel for the petitioners and the counsel appearing on behalf of the State.

The petitioners are aggrieved by the order dated 28.10.2017.

Learned counsel for the petitioners submits that in view of the judgment of the Apex Court in the case of Nirmala Kumari

Patna High Court CWJC No.5648 of 2018(2) dt.16-04-2018 2/2 and others vs. State of Bihar, Annexure-2 the respondents are required to pass fresh order as Annexure-2 is the settler on the point and as such the respondents are required to act in accordance with the principle laid down by the Apex Court in the case of Nirmala Kumari (Supra).

Considering the above, the writ petition is dispsoed of with direction tot he respondents to take fresh decision in the light of the judgment of the Apex Court in the case of Nirmala Kumari (Supra)contained in Annexure-2 within a period of sixty days.
