04-04-2019 Heard Sri Swapnil Kumar Singh, learned counsel for the petitioner and Sri Ramchandra Singh, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Kotwali P.S. Case No. 652 of 2018 registered for the offence under Section 406 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that though, in the case, alleged occurrence had taken place on 18-08-2018, to the reasons best known to the informant, written complaint by the informant was filed belatedly on 01-10-2018. He further submits that petitioner was employee of the informant and he has falsely been implicated in the present case.

Sri Ramchandra Singh, learned Addl. Public Prosecutor submits that as per fact disclosed in the case diary, two types of story have come out. One points out regarding involvement of the petitioner, whereas there is material on record, which suggests that petitioner was falsely implicated. In view of nature of accusation and facts & circumstances of the present case, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Dilip Singh @ Dilip Kumar Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Kotwali P.S. Case No. 652 of 2018, subject to condition as laid down under Section 438(2) of the Cr.P.C.
