JUSTICE SUDHIR SINGH ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 307/34 of the Indian Penal Code and 27 of the Arms Act. Subsequently, Section 304 of the Indian Penal Code is added. Allegation against the petitioner is that informant went to attend the marriage ceremony of daughter of Dilip Singh where petitioner was loading his country made pistol. Sonu Singh tried to snatch the said pistol from his hand and in course of snatching the pistol, firing was made and it hit the thigh of the informant. Later on, in course of treatment the informant died.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 28.7.2015. Chargesheet has been submitted under Section 304 of the Indian Penal Code in the present case. There is no allegation of tampering of evidence against the petitioner. From perusal of the F.I.R it would appear that it is a case of accidental fireing during the marriage.

On behalf of the State and the informant side, it is submitted that petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar, Judicial Magistrate, Ist Class, Bikramganj in connection with Dinara P.S. Case no. 53 of 2015.
