Initially, the case was registered under Section 328 and 302 of the Indian Penal Code but after investigation police submitted chargesheet for the offence punishable under Section 306 of the Indian Penal Code.

Although, informant claims that deceased was wife of the petitioner but submission made on behalf of the petitioner is that the deceased was working in orchestra party of the petitioner and pressurized the petitioner to solemnize his marriage with her but when petitioner refused to accept the aforesaid proposal of the deceased, deceased committed suicide.

Considering the aforesaid facts and circumstance of the

No.42464 of 2015 (2) dt.16-09-2015 P2/2 case as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Sathi P.S.
