The petitioner seeks bail in a case registered for the offences punishable under Section 323 and other Sections of the Indian Penal Code and under Sections 3(i)(x) of the SC/ST Act. The petitioner and other accused persons are alleged to have assaulted and asked the informant to withdraw the case. Tuntun Mandal is said to have assaulted the informant on his hand with iron rod and other accused alleged to have demanded extortion. The petitioner is in jail since 07.08.2015. It is submitted that all the offences alleged are bailable except Sections 3(i)(x) of the SC/ST Act. Similarly situated coaccused namely Jitan Mandal, Bipin Mandal and Tuntun Mandal have already been enlarged on anticipatory bail vide orders passed in Cr. Misc. No. 28864 of 2015.

No.43845 of 2015 (2) dt.22-09-2015 2/2 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Khagaria in Khagaria SC/ST P.S. Case No. 42 of 2014.
