Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 406, 409/34 of the Indian Penal Code.

Allegation against the petitioners is of misappropriation of Rs. 1,84,000/- of united fund of Primary Health Centre, Sanhoula, Bhagalpur.

It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case on mere suspicion. The present case has been lodged after a lapse of 9 years. It has been further submitted that petitioner no.

Patna High Court CR. MISC. No.7833 of 2020(2) dt.28-02-2020 2/2 1 being the head of Primary Health Centre was authorized to make expenses from the united fund which was audited and no objection was raised at the time of Audit and petitioner no. 2 thereafter issued cheques for payment. Petitioners have got no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on anticipatory bail in the event of their arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bonds of Rs. 20,000/- each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Sanhaulla P.S. Case No. 27 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
