JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-04-2019 This application, for grant of anticipatory bail, arises out of Nawkothi P.S. Case No. 106/18, disclosing offences under Sections 147, 149, 341, 323, 307, 354(B), 379, 504 and 506 of the Indian Penal Code.

Allegation against the petitioners is that they came variously armed and assaulted by means of spade and when his wife and brother in law came for rescue, his wife was thrashed on the ground and his brother in law was also assaulted causing injury to him.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.8365 of 2019(3) dt.22-04-2019 2/2 that there is case and counter case between the parties and wife of informant has not received any external injury and further there is land dispute between the parties and a proceeding under Section 144 Cr.P.C is also going on.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Begusarai, in connection with Nawkothi P.S. Case No. 106/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
