The petitioner seeks bail in anticipation of his arrest in connection with Baniyapur P.S. Case No. 314 of 2017 dated 20.11.2017 instituted for the offence under Section 392 of the Indian Penal Code.

Regard being had to the nature of accusation against the petitioner and the fact that he was identified by the informant at the time of the occurrence, I am not inclined to grant anticipatory bail to him.

Accordingly, the prayer for anticipatory bail is rejected.

However, if the petitioner surrenders before the

No.17582 of 2021(2) dt.07-01-2022 2/2 court below and seeks bail, all the grounds raised in the present petition as also he does not have criminal antecedents shall be taken into account and an order shall be passed without being prejudiced by the fact that the present petition on his behalf has not been entertained.
