2. Heard learned counsel for the petitioner and learned APP for the State.
3. The petitioner seeks bail in a case registered for the offence punishable under Sections-341, 323, 504, 506, 307/34 of the Indian Penal Code.
4. It is alleged that in the backdrop of petty feud, the altercation took place and in consequence thereof, the petitioner is alleged to have abused and assaulted the informant by fist and slaps. In the second episode of the occurrence i.e. 29-08-2023, the petitioner is alleged to have thrown a sprite bottle with
Patna High Court CR. MISC. No.8163 of 2025(5) dt.08-05-2025 2/2 intention to hit the informant but fortunately, he escaped.
5. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. He is a person of clean antecedent and injuries are simple in nature. Learned counsel has also submitted that other co-accused persons of similar nature have been granted bail. The petitioner is in custody since 09-10-2024.
6. Learned APP has opposed the prayer for bail.
7. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Xth, Gaya in connection with Guraru P.S. Case No. 166 of 2023 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
