The three petitioners in the two applications have moved this Court for grant of regular bail in a case registered
Patna High Court CR. MISC. No.14173 of 2021(3) dt.26-08-2021 2/3 under sections 376, 341, 342, 371, 370A, 372, 373 and 120B of the Indian Penal Code, sections 3, 4, 5, 6, 7 and 9 of the Immoral Traffic (Prevention) Act, sections 75, 81 and 84 of the I.T Act and sections 4 and 6 of the POCSO Act. As per allegation in the F.I.R., it is stated that on information having been received about practice of prostitution, a raid conducted and the girls recovered. It is stated that ten named accused persons including the three petitioners herein were involved in the said racket.
It is submitted by learned senior counsel for the petitioners that the allegations as levelled in the F.I.R. are false and concocted. The petitioners have been falsely implicated in the case. The petitioners have no criminal antecedent, are in custody since 30.10.2020 and investigation in the case has concluded. It is further submitted that their case stands on a similar footing to that of five other co-accused who have been enlarged on bail vide order dated 26.3.2021 passed in Cr. Misc. no.11222 of 2021 and order dated 7.7.2021 passed in Cr. Misc. no.15665 of 2021.

No.14173 of 2021(3) dt.26-08-2021 3/3 in the case having concluded and grant of bail to the other similarly situated co-accused, the Court directs the petitioners to be enlarged on bail in connection with Angarh P.S. Case no. 21 of 2020 (giving rise to Special POCSO Case no. 80 of 2020) on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VII-cum-Special Judge, POCSO Act, Purnea.
