2. The present application has been filed seeking cancellation of the regular bail granted to Opposite Party no. 2 vide order dated 07.12.2024 passed in B.P. No. 1876 of 2024 arising out of Patepur P.S. Case No. 249 of 2024, registered under Sections 191(2), 191(3), 190, 127(1), 115(2), 76, 109, 352 and 3(5) of the B.N.S.
3. Considering the subsequent events in the case, learned counsel for the petitioner is permitted to withdraw the present application with liberty to file an application for cancellation of bail before the learned Magistrate who granted
Patna High Court CR. MISC. No.11515 of 2025(6) dt.20-07-2026 2/2 bail to O.P. No. 2.
4. If such an application is filed, the same shall be considered and disposed of by the concerned Magistrate, in accordance with law, preferably within a period of one month from the date of its filing. While deciding the application, the court below shall consider all the grounds raised by the petitioner as well as the submissions advanced on behalf of the parties.
5. Accordingly, this application stands dismissed as withdrawn.
