Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Itadhi P.S. Case No. 237 of 2020, registered for the offence punishable under Sections 365, 367, 368, 370/34 of the Indian Penal Code. As per the prosecution case, petitioner along with other accused persons kidnapped the minor daughter of informant and sold her for Rs. 1, 10,000/- to human traffickers. It is submitted on behalf of the petitioner that FIR has been lodged after delay of two months. The victim girl has not alleged any foul against this petitioner in her statement under

Patna High Court CR. MISC. No.18935 of 2021(2) dt.09-07-2021 2/2 Section 164 Cr.P.C. Petitioner is in custody since 04.11.2020 having no criminal antecedent.

Learned APP however, vehemently opposed the prayer for bail and submitted that the victim girl has supported the prosecution case in her statement under Section 164 Cr.P.C. Considering the nature and gravity of offence, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
