JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking anticipatory bail in connection with Dharahara P.S. Case No. 151/2019 registered under Sections 304(B), 34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

Learned counsel for the petitioner submits that this petitioner is brother-in-law of the husband of the deceased, he lives separately with his family and has been made accused in this case only because he is one of the kith and kin of the husband as also that the father-in-law and motherin-law have already been granted privilege of anticipatory bail by learned coordinate Bench of this Court. Learned

Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that this petitioner is brother-in-law of the husband of the deceased, he lives separately with his family and has been made accused in this case only because he is one of the kith and kin of the husband as also that the father-in-law and mother-in-law have already been granted privilege of anticipatory bail by learned coordinate Bench of this Court, let the above-named petitioner, in the event of his arrest/surrender before the court below within a period of four weeks, be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Munger, in connection with Dharahara P.S. Case No. 151 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C. i.e. (i) a condition that the person shall make himself available for interrogation by a police officer as and when
