2. The present writ application has been filed for directing the respondents authorities to take appropriate action

Patna High Court CWJC No.14594 of 2017(2) dt.02-09-2025 2/3 against the private respondents who have still taken illegal possession on the ancestral land of the petitioner in spite of demarcation conducted by the concerned authorities in the light of the order dated 14.09.12 passed by DCLR, Bennipatti in case no-34/12-13 and also for a direction to the respondent authorities to remove the illegal possession of the private respondents from the ancestral land of the petitioner in the light of aforesaid order.

3. At the very outset, learned counsel for the State submits that the grievance that the petitioner has, she should have moved before the appropriate authority/court as it is against the private Respondents.

4. Learned counsel for the petitioner after some arguments submits that though he repeatedly approached Respondent No. 6 (the Sub-Divisional Magistrate, Benipatti, Madhubani), it remained unresponded.

5. In that background considering the submissions of the parties, liberty is granted to the petitioner to file a fresh petition before the Respondent No. 6 (the Sub-Divisional Magistrate, Benipatti, Madhubani) and if it is filed, after noticing, he shall be taking a decision in the matter.
