The petitioner apprehends his arrest in Giriyak P.S. Case No.105 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The learned counsel for the petitioner submits that from perusal of the seizure list at page 17, no recovery is made from the house of the petitioner but it appears that when the police went to raid the house on secret information, Ajo Yadav and Rupa Yadav were apprehended. Ajo Yadav is the brother of the petitioner and Rupa Yadav is the father of the petitioner. From the house of Rupa Yadav, 55 pouches each containing 200 ml. country made liquor was recovered. It has come that it was the petitioner who was dealing in illicit liquor. Taking into consideration the facts aforesaid, I am not
