2. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 56((b) of the Excise Act, 2018.

3. The learned counsel for the petitioner submits that the petitioner is in custody since 08.12.2022 and has antecedent of one case and the allegation is of recovery of 35 litres of liquor from a boat.

4. The learned counsel for the petitioner submits that petitioner was not arrested from the spot, as such, nothing was recovered from his conscious possession. It is also submitted that neither the liquor, nor the boat belongs to the petitioner.

5. Learned A.P.P. opposes the bail application.

6. Considering the submission made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-cum-Exclusive Special Excise Court-II in connection with Excise P. S. Case No.168c2/ 2020 bearing P.R. No.59 dated 2.12.2022.

7. The application stands allowed.
