2. Petitioner seeks regular bail in connection with Sessions Trial No. 966/2023 arising out of Laheri P.S. Case No. 166/2023, dated 13.03.2023 registered for the offences punishable under Sections 399, 402 and 411 of the Indian Penal Code and Sections 25(1-b)a and 26 of the Arms Act.

The main submissions advanced by learned counsel for the petitioner are that the FIR was registered under Sections 399, 402 and 411 of IPC and Section 25(1-b)a and 26 of the Arms Act among the alleged offences the offence of Sections 399 and 402 of IPC are not made out as the prosecution has not brought any evidence to show any type of preparation or planning on the part of the petitioner and co-accused persons to commit an offence when the co-accused persons were

No.11650 of 2024(2) dt.28-02-2024 2/3 apprehended, though as per allegation, a country-made katta, one live cartridge and a mobile phone are said to have been recovered but for the said offence he has been punished sufficiently and presently he is facing trial and the charges have been framed upon him on 15.12.2023 but till date no prosecution witness has turned up in his trial. Further submissions are that against the petitioner, there are criminal antecedents of six cases out of them, he has got bail in five cases and he has been languishing in jail since 14.03.2023.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

In the facts and circumstances of this case and considering the above submissions and mainly taking into account the petitioner's custody period and the stage of his trial, this Court is inclined to accept the bail prayer of the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Sessions Trial No. 966/2023 arising out of Laheri P.S. Case No. 166 of 2023 on the following conditions:- (i) Petitioner shall co-operate in the trial and shall be

No.11650 of 2024(2) dt.28-02-2024 3/3 properly represented on each and every date fixed by the trial Court and shall remain physically present as directed by the trial Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the trial Court.

(ii) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of his bail.
