JUSTICE SATYAVRAT VERMA ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner and Mr. Dr. Kumar Uday Pratap learned A.P.P. for the State. The petitioner seeks bail in connection with Suppi P.S. Case No. 41 of 2020 instituted for the offences under Section 272 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Amendment Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 17.12.2021 is a person with clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 108 liters of liquor from the house of the petitioner.

Learned counsel for the petitioner submits that the house is a joint family property and as such, petitioner was not knowing who had kept the liquor in the house.

Considering the fact that the petitioner is in custody since 17.12.2021 is a person with clean antecedent and chargesheet has been submitted in the case and he was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ -II cum Special Judge, Excise Act, Sitamarhi in connection with Suppi P.S.
