JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 304/34 of the Indian Penal Code.

The prosecution case as per F.I.R is that the son of the informant was removing the electricity wire which was fallen down due to its dilapidated condition after son of the informant cut the supply of the electricity from the transformer. The petitioner and other

Patna High Court CR. MISC. No.7414 of 2023(3) dt.02-05-2023 2/3 co-accused started the electricity supply and the son of the informant got electrocuted and died at the spot. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. For the alleged occurrence of 02.09.2021, the F.I.R has been registered on 05.09.2021 without explaining the delay. The informant is not the eye witness to the occurrence. The witnesses during the course of examination got hostile. The petitioner is languishing in custody since 16.05.2022. Moreover, other similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 02.08.2022 passed in Cr. Misc. No. 12916 of 2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District
