The petitioner seeks regular bail in connection with Ander (M.H. Nagar) P.S. Case No. 102 of 2018 registered for the offence punishable under Sections 272, 273 and 420/34 of the Indian Penal Code and Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 8.640 litres illicit liquor from the car of the petitioner. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the car in question does not belong to the petitioner and only because he is an accused in five other cases, he has been dragged in the present case. It is further submitted

Patna High Court Cr.Misc. No.7029 of 2019(3) dt.20-02-2019 2/2 that the petitioner is on bail in the said five other cases. Lastly, it is submitted that the petitioner is ready to abide by whatever conditions as may be imposed by this Court for the purposes of grant of regular bail. The petitioner is stated to be languishing in custody since 10.08.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd-cumSpecial Judge, Excise, Siwan in connection with Ander (M.H. Nagar) P.S. Case No. 102 of 2018.
