JUSTICE RAKESH KUMAR ORAL ORDER 05-04-2019 Heard Sri Dhirendra Nath Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Tarapur P.S. Case no.77 of 2014 registered for the offence under Sections 406, 420 of the Indian Penal Code, has prayed for grant of bail, in the event of his arrest or surrender. By way of referring to the F.I.R., it was submitted by learned counsel for the petitioner that in a commercial dispute, a colour has been given as if the petitioner has committed offence. He further submits that one of the co-accused, in similar circumstance, has been extended the privilege of anticipatory bail.

In view of facts and circumstances as well as nature of accusation, in the event of his arrest or surrender within a period

Case No.77 of 2014, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
