Learned counsel for the petitioner submits that during pendency of this case matter has been settled and petitioner is no longer interested to press this writ petition as in terms of agreement he has already deposited the initial amount. The intervener has filed I.A. No. 6358 of 2017 for impleading him as party.

As the petitioner does not want to press this writ petition the question of impleadment of the intervener does not arise. It

Patna High Court CWJC No.10569 of 2016 (2) dt.01-11-2017 has also been informed at the Bar that SARFAESI appeal is pending before Debt Recovery Tribunal, Patna. The Tribunal is directed to look into the matter and pass an order in accordance with law.

With the aforesaid observation and direction this writ petition is disposed of.
