JUSTICE AMARESH KUMAR LAL ORAL ORDER 09-02-2015 Both these applications arise out of Akbar Nagar P.S. Case no. 4 of 2010. As such, they have been heard together and are being disposed of by this common order.

Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case for the offence punishable under Sections 307, 379, 380, 353 and other allied sections of the Indian Penal Code, section 27 of the Arms Act and Section 17 of the C.L.A. Act. Considering that the F.I.R. was lodged against unknown, during investigation the name of the

No.40150 of 2014 (3) dt.09-02-2015 2/2 petitioners appeared in the confessional statement of the co-accused and the co-accused on similar situation has been granted bail, the above-named petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Adhoc Addl. Sessions Judge-IV, Bhagalpur in S.T. no. 1134 of 2013/293 of 2014 ( in case of petitioner Suresh Yadav) and learned Sri Kumar Amit Manu, Judicial Magistrate, Ist Class, Bhagalpur, in Akbar Nagar P. S. Case no. 4 of 2010, G.R. no. 97 of 2010 ( in case of petitioner Bhim Turi) with the following conditions :

1. One of the bailors will be the close relative of the petitioners.

2. The petitioners will not indulge in similar or in any other offence.

3.

The petitioners will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bonds will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) sudip/- U T
