JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased, who died in other than normal circumstances within three years of her marriage. The informant admitted in his written report that his daughter died on 13.07.2014 in hospital and after her death, the dead body was brought to the house of the petitioner. The informant also admitted that he, too, went to the house of the petitioner and thereafter, dead body was cremated though he was confined in a room by the petitioner and his other family members. The informant also admitted in his written report that he got information about the condition of the deceased on 13.07.2014 through the younger brother of the petitioner.

Patna High Court Cr.Misc. No.44315 of 2015 (3) dt.05-01-2016 2/2 Learned counsel for the petitioner submits that as a matter of fact, after cremation of dead body, the local enemies of the petitioner got instituted the present case and that is the reason informant did not lodge any case just after the death of his daughter.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Nawanagar (Sonbarsa) P.S. Case No. 130 of 2014.
