2. The present petition has been preferred for the following relief(s):

"for issuance of an appropriate writ or writs, order or orders or direction or directions for disposal of the representations dated 6.1.12 and 26.9.14 (Annexure- 1 and 1/1) of the Petitioner before the respondent No.2 thereby the Petitioner demanded to make Payment of the Award in L.A. Case No.74/11-12 in respect of Khata No.33 Plot No. 530. Thane No.8 situated in village Narayana. P.S. Fatuah District Patna in construction of N.H.

3. A counter-affidavit has come on behalf of the Land Acquisition Officer, Patna after duly service of copy to the learned counsel for the petitioner and as per paragraph-6 one Bindeshwari Singh s/o late Ram Briksh Singh of Abdalpur, Fatwa, Patna submitted the claim and got the compensation amount. The petitioner is neither the owner of the land in question nor any claim has been laid by him.

4. As recorded, the counter-affidavit was served on 04.08.2017 and there is no rebuttal/rejoinder to it.

5. However, since there is no appearance, the writ petition stands dismissed for non-prosecution. (Rajiv Roy, J) Adnan/- U
