Mr.Lalit Kishore, AG ====================================================== CORAM: HONOURABLE MR. JUSTICE JYOTI SARAN and HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER (Per: HONOURABLE MR. JUSTICE JYOTI SARAN) 10-05-2019 Heard learned counsel for the parties.
The writ petition is filed in the nature of a Public Interest Litigation to question the decision of the State Government to cancel deputations of some officers and for sending them to parent department for better administration. Apart from the fact that a cancellation of deputation, gives no cause of action to anyone much less in public interest,
Patna High Court CWJC No.2753 of 2018(2) dt.10-05-2019 2/2 the grievance raised is against implementation of a policy decision of the State Government in cancellation of deputation of the officers of different Departments and posting them to their parent department.
Considering that the issue relates to condition of service which affects individually and gives no cause of action to anyone because deputation cannot be claimed as a right, we see no reason to grant any indulgence to the issue raised. The writ petition is disposed of.
