JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was made accused on the basis of the fardbeyan of informant which was recorded on 08.11.1998 and after that, Singhia P.S.Case No. 71 of 1998 was registered but after due investigation, police found the accusation untrue in respect of the petitioner and accordingly, he was not sent up for trial. Police submitted charge sheet against the other accused, who faced trial and in course of trial, the prosecution filed an application under Section 319 of the Cr.P.C. and accordingly, petitioner was summoned to face trial along with other accused sometime in the year 2013 and, thereafter, petitioner came before this court for grant of anticipatory bail which was disposed of on

Patna High Court Cr.Misc. No.43918 of 2015 (2) dt.22-09-2015 2/2 29.06.2015 directing the petitioner to surrender before the court below and seek regular bail. Accordingly, petitioner was remanded in this case on 05.08.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Adhoc Additional District Judge, Rosera, Samastipur in connection with Singhia P.S.Case No.71 of 1998.
