11-04-2022 Heard learned counsel for the parties.

The petitioner seeks bail in a case registered for the offence under Sections 147, 148, 149, 323, 341, 324, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. It is submitted on behalf of petitioner that though, petitioner is named in the F.I.R., but there is no specific overt act has been alleged against him. Petitioner is only alleged to be member of the mob. There is case and counter case. Specific allegation of assault is against other co-accused persons. As per post-mortem report also, the cause of death of deceased is head injury, which as per F.I.R., caused through farsa and rod by coaccused Md. Mansoor and Md. Tamanna. Petitioner is in custody since 12.06.2021.

Patna High Court CR. MISC. No.7847 of 2022(2) dt.11-04-2022 2/2 However, learned counsel for the State and Informant vehemently opposed the prayer for bail and submitted that petitioner is named in the F.I.R. and has also participated in the alleged occurrence.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Jaynagar P.S. Case No. 195 of 2020.
