1. That the Present writ petition is for set aside the Order dated 24.11.2011, passed by District Collector, Gopalganj. in Miscellaneous Case No.- 01 of 2011, cancelling Jamabandi, along with pertaining to Khata No. 157, Khesra No.- 758, Area- 19 Katha 6 Dhur at VillageKaparpura, Achal- Uchkagaon in District of Gopalganj and further Order regarding cancellation of Certificate along in question granted by Bhudan Yagya Committee and

Patna High Court CWJC No.4218 of 2018 dt.11-11-2024 2/3 recommended for construction of Stadium upon said land ignoring it, that Dan Patra granted in his favor was conform by said committee, i.e., Competent body, and for other necessary relief/reliefs to the basis of facts and circumstances enumerated and stated hereinafter.

2. Learned counsel for the petitioner submits that he has approached this Court earlier in the year 2010 and in the light of direction by the Court, he had represented before Additional Collector, Gopalganj but District Magistrate has directly intervened in the matter and he has rejected the grievance of the petitioner. He further submits that petitioner has approached this court for redressal of his grievance.

3. Learned counsel for the State submits that for redressal of grievance, petitioner may have filed revision against the order of Collector as mentioned in para-12 of counter affidavit but petitioner has directly approach this Court though he has efficacious remedy available.

4. In the light of aforesaid facts and circumstances of the case, the present petition stands disposed of with direction to approach appropriate forum within four weeks

5. It is needless to mention that the period spent in pursuing the matter before this court be considered sympathetically while dealing with the aspect of condonation of delay.
