JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2019 The petitioner apprehends his arrest in connection with Agamkuan P.S.Case No. 630 of 2018 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 25 litres Mahua liquor from the Scooty of the petitioner.

Submission of learned counsel for the petitioner is that petitioner has no criminal antecedent and he has been falsely implicated in this case and petitioner is ready to abide by any condition imposed upon him.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail

Patna High Court CR. MISC. No.11340 of 2019(2) dt.25-02-2019 2/2 upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Agamkuan P.S. Case No. 630 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that if in future petitioner was found in active participation in any such type of similar offence, prosecution shall have liberty to move for cancellation of his bail bond.
