The petitioners seek bail in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant named 14 persons and alleged that all the accused persons have armed with different weapons came. The petitioners were not armed with firearm except petitioner no. 2. It is said that petitioner no. 2 was armed with bomb. Pankaj Mishra and Ajay Mishra got firearm injuries.
It is submitted that no other persons were injured. Learned counsel for the informant as well as learned
Patna High Court Cr.Misc. No.44130 of 2015 (3) dt.29-09-2015 2/2 APP however opposed the prayer for bail and submitted that the learned counsel for the informant could not be able to procure the injury report.
Having considered the facts that the petitioners were not armed with any firearm and the injured Pankaj Mishra and Ajay Mishra got firearm injuries, the petitioners above named are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Rameshwar Mishra, the learned Judicial Magistrate, 1st Class, Begusarai in Naokothi P.S. Case No.61 of 2015.
