Learned counsel for the petitioner undertakes to remove the defects within three weeks, if any. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in this case. He submits that there is general and
Patna High Court CR. MISC. No.14871 of 2020(3) dt.06-01-2022 2/2 omnibus allegation levelled against the petitioner. Petitioner is the husband of the opposite party no. 2. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.
Learned APP for the State opposed the prayer for bail and submits that there is specific allegation against the petitioner.
Vide order dated 10.07.2020, notice was issued to the opposite party no. 2 but requisites has not been filed by the petitioner.
Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection Complaint Case No. 107(c)/2017 pending before the court of the learned S.D.J.M., Begusarai.
