JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-12-2021 Let the defects, as pointed out by the office, be removed when called upon to do so by the office. Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered in connection with Patori P.S Case No. 188 of 2019 for the offences punishable under Sections 147, 149, 307, 323, 324, 325, 341, 379, 504, 506 of the Indian Penal Code. Learned counsel for the petitioner prays to withdraw the application of petitioner no. 2 namely, Chhavidhar Ray. Accordingly, anticipatory bail application of petitioner no. 2 is dismissed as withdrawn.

No.17534 of 2021(2) dt.13-12-2021 2/2 As per prosecution case, while informant Awadhesh Ray was at his home Shashidhar Rai along with other accused assaulted the informant with lathi causing his right hand fracture and also sustained injury over right eye. It is further alleged that when his wife came to rescue petitioner and other accused assaulted with Farsa and daughter with danda. Learned counsel for the petitioner submits that allegation against the petitioner no. 1 is that he assaulted the informant by means of lathi from which informant sustained injury upon hand which is not vital part of the body. In the facts and circumstance of the case, let the petitioner no.

2, above named, in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IV, Samastipur in connection with Patori P.S Case No. 188 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C N.
