2. The petitioner is aggrieved with the order dated 05.02.2024 passed by the District Magistrate, Saran, Chapra as contained in Memo No. 158, by which the petitioner has been inflicted with the punishment of compulsory retirement.
3. At the outset, learned counsel for the State made a preliminary objection with regard to the remedy of appeal as provided under Rule 23 of the Bihar Government Servants (Classification, Control and Appeal) Rules, 2005.
4. In view of the submissions advanced and
Patna High Court CWJC No.4097 of 2025(2) dt.18-03-2025 2/2 considering the fact that the petitioner has appropriate remedy of appeal before the appellate authority, the writ petition stands disposed off with the liberty aforesaid.
5. Suffice it to observe that in case appeal is preferred within a period of thirty days, the same shall be considered and disposed off expeditiously.
