The petitioner is in custody in connection with Excise Case No. 200 of 2019 (PR. No. 54 of 2019), for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 22.12.2019. He further submits that in the instant case total 100 litres of foreign liquor was seized. He submits that nothing recovered from the conscious possession of the petitioner. He further submits that no sampling was done in the instant case and there is no FSL report to confirm that the seized material was liquor.

No.5647 of 2020(2) dt.31-01-2020 2/2 Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Muzaffarpur in connection with Excise Case No. 200 of 2019 (PR. No. 54 of 2019).
