JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 17-01-2018 Having heard learned counsel for the parties, we are of the considered view that interest of justice would be met in case coercive step for recovery of surety in question is kept in abeyance till appointment of Chairman, Commercial Taxes Tribunal, Bihar, Patna, and consideration of the application for stay, filed by the petitioner.

We are informed that the process of appointment of the Chairman is in progress and he will be appointed within a reasonable period of time.

In that view of the matter, we dispose off the matter

Patna High Court CWJC No.1068 of 2018 (2) dt.17-01-2018 2/2 in the aforesaid direction and implementation of the Letter No. 7545 dated 02.01.2018, is stayed till the consideration of the matter before the Chairman of the Tribunal.
