ANJANA MISHRA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are father-in-law and mother-in-law of the deceased and have been made accused in Manjhagarh P.S.Case No.192/13 for the offence under Sections 304-B and 201/34 of the I.P.C.
It has been submitted on behalf of the petitioners that the allegations against the petitioners are only general and omnibus in nature and there is no cogent material so as to connect them with the present case.
However, the F.I.R. itself is quite explicit that how the parents alone were responsible for the demand of dowry and
Patna High Court Cr.Misc. No.40695 of 2014 (3) dt.08-01-2015 2/2 torture to the daughter of the informant whose marriage was solemnized with the son of the petitioners on 4.7.2013. The said allegation also finds supports in the case diary. The prayer for bail of petitioner no.1 is, thus, rejected.
So far as the petitioner no.2, Bhagyawani Devi @ Bhagyawanti Devi is concerned, who is the wife of Yogendra Mahato, she is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in Manjhagarh P.S.Case No.192/13.
