The petitioner is languishing in custody since 16.10.2013 in a case registered for the offences punishable under Sections 498A and 304B/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant within three years of the marriage for nonfulfillment of the dowry demand by administering poison. It is submitted by learned counsel for that the petitioner that the victim died due to the snack bite. The report of the FSL reflects that the victim consumed Aluminum Phosphide commercially known as Celphos.

Patna High Court Cr.Misc. No.40731 of 2014 (03) dt.09-02-2015 2/2 Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner in connection with Sessions Case No. 143 of 2014 arising out of Parbatta P.S. Case No. 07 of 2011 pending in the court of learned III Ad hoc Additional Sessions Judge, Khagaria.

Accordingly, the prayer for bail of the petitioner is rejected.
