JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2015 Both petitions arise out of Kharagpur P.S. Case No. 184 of 2012 and accordingly, both the above-said petitions are being heard and disposed off by this common order.

Heard learned counsels for the petitioners and learned Additional Public Prosecutor for the State.

The present case has been registered for the offences of Indian Penal Code as well as u/S 10/13 of UAPA Act. The oofences of UAPA Act are schedules offence as per scheduled, given in National Investigation Agency Act, 2008 but admittedly, uptill now, the investigation of the present case has not been taken

Petitioners are named in the first information report but admittedly, neither they were caught at the spot nor anything has been recovered from their conscious possession. No doubt, petitioners carry criminal antecedent but the co-accused, who was caught at the spot and the accused on whose direction, the demand of extortion was made, have already been granted privilege of bail by different benches of this court.

Taking into consideration the aforesaid facts and circumstances as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kharagpur P.S. Case No. 184 of 2012 to the satisfaction of Chief Judicial Magistrate, Munger. (Hemant Kumar Srivastava, J) A.K.V./- U T
