The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that the informant got an information that some persons are taking illegal possession of his land. When the informant and his son reached there, he saw that Md. Hasim and his sons Md. Pappu and this petitioner are digging a

Patna High Court CR. MISC. No.7723 of 2022(2) dt.08-08-2022 2/3 ditch on his land. When the informant raised protest, the accused persons started abusing and Md. Hasim ordered to kill them. Thereafter, Md. Hasim caught the informant and pulled him down on earth. Md. Anjar assaulted the informant's son on his head and nos by the butt of the pistol. The petitioner also assaulted him by iron rod. The accused persons also took away rupees ten thousands from the pocket of the son of the informant.

It is submitted by learned counsel for the petitioner that in the background of some land dispute, the present F.I.R has been registered. There is no accusation of repeating the blow. The injuries of the injured have been found to be simple in nature. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on
