Petitioner apprehends arrest in case registered for the offences punishable under Sections 376, 341, 323, 504, 506/34 of the Indian Penal Code.

As per prosecution case, this petitioner is alleged to have intercepted the informant, dragged her into a room and committed rape on her.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Petitioner has got clean antecedent. Learned counsel for the State opposes the bail application and submits that victim has supported the

Patna High Court CR. MISC. No.11081 of 2023(2) dt.16-05-2023 2/2 prosecution case in her statement recorded under Section 164 of the Cr.P.C.

In view of the statement of the victim recorded under Section 164 of the Cr.P.C., prayer for anticipatory bail of the petitioner is refused.
