The petitioner apprehends his arrest in Muffasil P.S. Case No.482 of 2019 registered under Sections 414 and 120(B) of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act.

The police on secret information that Rohit Kumar indulged in the trade of illicit liquor with the help of his friend and he had brought a truck loaded with liquor. On such, a raid was conducted in the saw mill of Rohit Kumar. Rohit Kumar and Jitendra Kumar were apprehended from the saw mill. 407.625 litres of liquor was recovered from the saw mill. Rohit Kumar and Jitendra Kumar are said to have disclosed the name of the petitioner and others.

Learned counsel for the petitioner submits that Rohit Kumar and Jitendra Kumar have already been granted regular

Patna High Court CR. MISC. No.6668 of 2020(2) dt.11-06-2020 2/2 bail. Vishal Kumar was also granted regular bail. Amit Kumar, Mikku Kumar, Kunal Kumar, Manish Kumar have been granted anticipatory bail by different benches of this court. The case of the petitioner stands on the same footing as the name of the petitioner also surfaced in the case in the disclosure made by Rohit Kumar and Jitendra Kumar.

Having considered the facts that no liquor has been recovered from possession of the petitioner and the name of the petitioner surfaced in the case in the disclosure made by Rohit Kumar and Jitendra Kumar, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II-cum-Special Judge, Bihar Prohibition and Excise Act, 2016, Begusarai in connection with Muffasil P.S. Case No.482 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
