Case No.80 of 2014 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code read with Section 47A of the Bihar Excise Act.
The allegation against the petitioner is that he was found driving a vehicle bearing Registration No.BR-5G 5977 in which considerable number of liquor pouches were being carried. Thereafter, the case was registered. Bail Petition No.384 of 2014 filed by the petitioner was rejected by the Court of 1st Additional Sessions Judge, Madhubani on 16.09.2014. Hence, this application.
The petitioner is just a driver of the vehicle. It was not even alleged that he was involved in illicit transport of the
Patna High Court Cr.Misc. No.43280 of 2014 (3) dt.03-03-2015 2/2 liquor. Further, even according to the F.I.R., the petitioner was found in an injured condition. This Court is satisfied that the petitioner deserves bail.
Hence, this application is allowed. The petitioner shall be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Basant Kumar, learned Judicial Magistrate 1st class, Madhubani in connection with Kaluahi P.S. Case No.80 of 2014.
