JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-12-2021 Let the defects, as pointed out by the office, be removed when called upon to do so by the office. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered in connection with Mahua P.S Case No. 439 of 2020 for the offences punishable under Sections 457, 380, 323,154 of the Indian Penal Code.

As per prosecution case, the informant Sobha Devi w/o Arbind Singh was sleeping in her house, saw three persons taking her jewellery, she raised alarm and identified one person to be co-villager Raj Kumar. Thereafter, Rajkumar started misbehaving and one Raja Singh snatched Gold chain and fled away.

Patna High Court CR. MISC. No.17483 of 2021(2) dt.13-12-2021 2/2 Learned counsel for the petitioner submits that there is a land dispute between the petitioner and Nawal Jha. Arvind Singh is henchman of Nawal Jha and the said Nawal Jha managed with the help of Arvind Singh and filed false case by informant. The petitioner is aged about 18 years and the informant is aged about 30 years and they are co-villagers. Petitioner was not arrested on the spot and falsely implicated in this case.

In the facts and circumstance of the case, let the petitioner , above named, in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S Case No. 439 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
