JUSTICE BIRENDRA KUMAR ORAL ORDER 13-02-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Giriyak P.S. Case No.244 of 2018, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Petitioner is owner-cum-driver of the referred marshal jeep. Allegation is that the petitioner was driving after taking wine and dashed the vehicle against a motorcycle causing injury to two persons. From the vehicle 600 ML foreign liquor was recovered. The petitioner has got no criminal antecedent. Considering the nature of allegation and material,
