JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is allegation of rape against the petitioner and the injury report of the victim has been incorporated by the investigating officer at para-32 of the case diary which goes to show that some injuries were found on the private part of the victim who was found between four to five years at the time of alleged occurrence.

Regard being had to the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Trial No. 11 of 2015 arising out of Gopalganj Mahila P.S. Case No. 27 of 2015 pending in the court

Patna High Court Cr.Misc. No.43709 of 2015 (3) dt.04-01-2016 2/2 of 1st Additional Sessions Judge, Gopalganj stands rejected. However, learned trial court is directed to expedite the trial of the petitioner and conclude the same as early as possible.
