====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 14-10-2022 Heard learned Senior counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner apprehends her arrest in a case registered for the offences punishable under Section 7 E.C. Act. The informant alleges that during inspection of the P.D.S. of the petitioner certain irregularities were found and after inquiry, it transpired that petitioner had committed black marketing of 179 bags of food grains.

Learned Senior counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is also submitted that had an opportunity been given to the petitioner to explain her side of the case perhaps, the present FIR would not have been instituted.

No.7596 of 2022(3) dt.14-10-2022 2/2 Learned Senior counsel also submitted that none of the beneficiaries complained against the petitioner that they are not getting the food grains according to their entitlement, it is next submitted that petitioner has already suffered cancellation of the license without giving her an opportunity to explain her case as such, she has already suffered.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Baisi P.S. Case No. 141 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
