Petitioner is not named in the first information report and it appears that one Rasulpur P.S. Case no. 136/2012 under section 414/34 of the Indian Penal Code was registered against the petitioner and others and in that case, stolen idols were recovered. Although the aforesaid case reveals that the above stated recovery was made from possession of the petitioner and co-accused Ram Pravesh Yadav but the first information report of the aforesaid case reflects that the petitioner had fled away from place of occurrence when the police party reached and the aforesaid recovery had not been made from the possession of the petitioner. Moreover, petitioner has already been granted privilege of bail in the above stated case. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
