The petitioner apprehends his arrest in a case registered for the offence under Section 302 of the Indian Penal Code.

As per the prosecution case, on 11.07.2019 at 10:00 PM, some unknown persons assaulted and badly injured son of the informant and threw him down the stairs, while he was being treated in the hospital, and he succumbed to the injuries. It is submitted on behalf of petitioner that there is delay of 20 days in lodging the F.I.R. and there is no plausible explanation of delay. During course of investigation, several witnesses have stated that the deceased died due to fall from roof. It is further submitted that there is no tangible evidence to show complicity of petitioner in the aforesaid crime. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.8240 of 2022(3) dt.16-11-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IX, Hajipur, Vaishali in connection with Jurawanpur P.S.
